Terms of service

The agreement for using Thrum.

Last updated

1. These terms

These terms are the agreement between you and us for using Thrum: the app at app.thrum.run, the client portals, forms, blogs and pages it serves, and this site. By creating an account or using Thrum, you agree to them.

If you use it for a company, you agree for that company, and “you” means the company.

2. Who Thrum is for

Thrum is for businesses: freelancers, agencies and owners who run automation for their own business or for their clients. You must be 18 or older and able to make a binding contract. It is not for personal or household use.

3. Your account

Keep your sign-in safe, and tell us at hello@thrum.run if you think someone else has used it. You are responsible for what happens in your workspace, including what your team members and the client users you invite do there.

Sign up with an email address you can receive mail at. We refuse addresses from throwaway email services, and a sign-up nobody confirms is deleted after 7 days.

4. Early access

While Thrum is in early access, signing up puts you on the list. Nothing starts and nothing is billed until you are let in, and we decide who gets in and when.

5. Plans, trials and payment

Plans are priced per seat, monthly or yearly, as shown on the pricing page. A new workspace starts with a 14-day trial, with no card needed.

Payments are handled by Lemon Squeezy, which acts as the merchant of record: it sells you the subscription, charges your card and handles sales tax and VAT. Its own terms apply to the purchase.

A plan renews at the end of each period until you cancel it. You can cancel at any time in Plan and billing, and the plan runs to the end of the period you paid for. Fees are not refunded for part of a period, except where the law requires it.

We may change our prices. A new price applies from your first renewal at least 30 days after we tell you about it.

6. When a plan ends or a payment fails

When a trial ends without a plan, a cancelled plan reaches the end of its period, or a payment cannot be collected:

  • For the first 7 days everything keeps running, and the owners get reminders.
  • Then the workspace pauses. No new workflow runs start, and the app is read-only, but you can still export your data, choose a plan or delete your account. Client portals stay up.
  • Forms keep collecting responses until 37 days after the start, then stop accepting them.

Your data is kept while the workspace is paused. Choosing a plan resumes everything.

7. Your data and your clients’ data

What you put into Thrum, and what your clients and their customers send through it, is yours. You give us permission to store, process and show it only to run Thrum for you.

For data about your clients and their customers, you decide what is collected and why, and we process it on your behalf. You are responsible for having the right to collect it and for telling people how it is used, for example in your own or your client’s privacy notice. Our privacy policy covers the data about you.

You can export your data from the app while your workspace is active or paused. If you delete a workspace, you can restore it for 30 days; after that its data is deleted.

8. Email and text messages

Thrum sends the email and text messages that you and your clients set up. Send them only to people who have agreed to hear from you or your client, or where the law otherwise allows it, and follow the rules that apply to you, such as CAN-SPAM, GDPR, PECR and, for texts in the US, the TCPA.

Marketing email carries an unsubscribe link and the client’s postal address. Do not remove or hide them. We may pause sending from a domain when its bounces or complaints climb.

9. What you may not do

You may give your clients access to their own portals and charge them for your services. You may not use Thrum to:

  • break the law, or help anyone else break it;
  • send spam or phishing, or collect data by deceiving people;
  • store or send malware, or content that is illegal, hateful or infringes someone else’s rights;
  • get into Thrum, another workspace or anyone else’s systems without permission, or test our security in a way that goes beyond what our Security page invites;
  • overload Thrum, or get round its limits other than by adding seats or changing plan;
  • copy Thrum to build a competing product.

10. Other services

Thrum connects to services that you or your clients choose, such as Stripe, Twilio, Google, Slack and OpenAI, on your or your client’s own accounts and keys. Their terms govern your use of them, you pay them directly, and we are not responsible for them or for what they do with the data you send them.

Features that use AI run on your own key with the AI provider.

11. Beta features

A feature marked Beta is built and tested, but has not yet run against the live service it depends on. It may change, and it may have problems that only a live service shows. Use it with that in mind.

12. Changes to Thrum

We keep improving Thrum, so features change. We aim to keep it running without interruption, but we do not promise that it always will, or that it is free of errors, and no plan comes with an uptime guarantee. If a change takes away something you rely on, we will tell you before it happens where we can.

13. Suspending or closing an account

You can stop using it and delete your workspace at any time.

We may suspend or close an account that breaks these terms, puts other people or our service at risk, or that the law requires us to act on. Where we can, we will tell you first and give you time to put it right or to export your data.

14. Warranties

Thrum is provided as it is and as available. As far as the law allows, we give no warranties beyond those in these terms, including any that it is fit for a particular purpose.

15. Liability

As far as the law allows, we are not liable for indirect or consequential loss, or for lost profits, revenue, business or goodwill. Our total liability for any claim about these terms or the service is limited to the greater of the fees you paid us in the 12 months before the claim and US$100.

Nothing in these terms limits liability that the law does not allow to be limited, such as for fraud, or for death or personal injury caused by negligence.

16. Claims about your content

If someone makes a claim against us about content that you or your clients put into or sent through the service, or about your breaking these terms, you will cover our reasonable costs of dealing with it.

17. Changes to these terms

We will post a new version here with its date. For a change that matters, we will email account owners at least 30 days before it applies. Using the service after that means you accept the new terms.
